In these conditions the following definitions apply:
1. Muso: The Company / Supplier.
2. Buyer: the natural person who does not act in the course of a profession or business and enters into a distance contract with Muso.
2. Applicability
The Buyer (customer) accepts these terms and conditions when placing an order. These general terms and conditions apply to the offer of Muso and to any distance agreement concluded between Muso and the Buyer. Muso expressly excludes the applicability of the Buyer's (delivery) terms and conditions, unless expressly agreed otherwise in writing.
3. Agreement
The agreement is concluded at the moment of acceptance by the Buyer of the offer and compliance with the accompanying conditions. The order will be put into production after the supplier has received payment of the agreed price. All orders are subject to our General Terms and Conditions. The order will be confirmed immediately by email. Once the order has been put into production, cancellation of the order is no longer possible. We will confirm your order immediately by email.
4: Delivery times
The estimated delivery times communicated via email are representative of the average delivery times. The delivery location is the address provided by the Buyer to Muso. Neither can be the reason for any compensation, cancellation of an order, or any other form of compensation.
5: Payment
The Buyer places the order by making a payment in our ordering process. Upon receipt of your payment, your order will be placed and the agreement will be compiled. After we have received your payment, we will send you a confirmation by email. Prices on the website, emails, and in promotional materials are for informational purposes only and may vary from time to time. All prices on the website include value-added tax (VAT).
6: No right of withdrawal
The right of withdrawal does not apply to our products as they are made according to the buyer's specifications or clearly personalized and, due to their nature, cannot be returned.
7: Warranty
Muso does not guarantee the durability of the delivered product due to exposure to UV radiation and other environmental factors. If the product exhibits a material or manufacturing defect, the Buyer is entitled to free repair or replacement of the product. The Buyer is only entitled to replacement if repair of the product is not possible. No warranty applies to damage caused by incorrect use or application of the delivered products. The purchase receipt (order confirmation after payment) serves as the warranty certificate. If repair or replacement is impossible, Muso has the right to terminate the agreement and fully credit the Buyer.
The Buyer is aware that Muso sells reproductions, which are copies of the original painting. Deviations between the delivered product and the original painting cannot be a reason for rejection, discount, termination of the agreement, or compensation.
The quality of our photo prints depends on the quality of the image material provided by the Buyer, and therefore we cannot accept claims based on differences in colors between a print and the original digital image. If you are dissatisfied with your order or our service, we kindly request you to inform us within 14 days of receiving your order so that we can offer you a suitable solution.
8: Intellectual property rights
The Buyer guarantees that he/she possesses all copyright and other rights regarding the provided visual material. Muso can never be held accountable or liable in any way for such material. Files provided by the Buyer are solely used for the agreed-upon assignment between Muso and the Buyer. Muso does not use customer-provided image files for any purpose outside of the assignment without written permission from the customer. This includes printing, digital use, publication, or sharing of the file in any other manner.
9: Liability
Muso is not liable for any damages of any kind that arise from Muso relying on incorrectly provided information by the Buyer or from the improper use of the products after delivery by the Buyer. In the event that Muso is liable for damages to the Buyer resulting from a failure to perform under this agreement, Muso's liability will be limited to a maximum of the purchase price.
10: Privacy
The personal data collected by Muso is solely used for the operation of Muso's business. Personal data will not be disclosed to third parties. Data will only be disclosed to third parties in the following cases: if required by legal regulations.
11: Applicable law
The legal relationship between Muso and the Buyer is exclusively governed by Dutch law. Any potential disputes will exclusively be submitted to the competent court of the District Court of Oost-Brabant, located in 's-Hertogenbosch.
